Online Registration: Event Participant Release for HF@25 

In consideration of my participation at the Hadassah Foundation’s 25th anniversary celebration (the “Event”), I, on behalf of myself, my family members, next of kin, heirs, representatives, successors and assigns hereby forever release, discharge and covenant not to sue The Hadassah Foundation, Inc., Hadassah, The Women’s Zionist Organization of America, Inc. and each of their affiliates, related entities, officers, directors, employees, volunteers, donors, representatives, agents, successors, assigns, subcontractors, and licensees (hereinafter collectively, the “Hadassah Foundation”) from any and all claims, demands, suits, actions and liability of any kind whatsoever, including those which have not yet arisen or matured, arising from, related to, or in connection with my participation in the Event, any Event-related activities, my travel to, during and from the Event, any property damage, loss or theft, any negligence on the part of the Hadassah Foundation or any negligence and/or intentional act on the part of any other person or entity, any bodily, emotional or mental injury, illness or exposure to illness (including without limitation COVID-19), disease, or death in connection with my attendance at the Event, and all other claims, liability, damage, cost, loss or expense of any nature whatsoever. I further acknowledge and agree that, notwithstanding any security arrangements that the Hadassah Foundation may make, the Hadassah Foundation does not guarantee and is not liable or responsible for my personal safety or the safety of my property while participating in the Event, any Event-related activities, or any travel to, during, and from the Event. Additionally, I agree to indemnify, defend and hold harmless the Hadassah Foundation from any and all claims, liability, demands, damages, costs, losses, suits and expenses (including attorney’s fees) arising from, related to, or in connection with the Event or the enforcement of or attempt to enforce this Event Participant Release, whether by action of law or otherwise.

All Event-related activities and speakers are subject to change without notice, and such change, substitution or withdrawal is not a basis for participant cancellation or refund.

I hereby irrevocably grant to the Hadassah Foundation the right to stream, post, photograph, film, and/or otherwise record, by any and all methods now or hereafter known, my image, voice and/or likeness and to license, distribute, disseminate, display and/or otherwise use my name and/or any stream, post, photograph, image, audio and/or visual recording, or likeness in which I may appear or any utterance or statements I may make in the course of my participation in the Event, including any photographs, images, audio and/or visual recordings I may provide to the Hadassah Foundation or its designees, or any portion thereof, in any media throughout the world, including, but not limited to, all digital media such as websites, emails, virtual meeting platforms, and social media, any number of times, in any and all manners, and by any and all means now or hereafter known, for any advertising, trade, fundraising, promotional or for any other purpose, without my approval or any compensation unless required by law. I certify that I own or have the proper rights to license, distribute, disseminate, display and/or otherwise use any statements, photographs, images, audio and/or visual recordings that I may provide to the Hadassah Foundation or its designees for the purposes described in the preceding sentence. I agree that any stream, post, photograph, image, audio and/or visual recording, likeness, utterance or statement made during the course of the Event shall be owned by the Hadassah Foundation and shall be the Hadassah Foundation’s sole and exclusive property, and the Hadassah Foundation shall have the right to edit any such materials in the Hadassah Foundation’s sole discretion. I hereby release the Hadassah Foundation from any and all liability in connection with the use of my name and/or any such stream, post, photograph, image, audio and/or visual recording, likeness, utterance or statement. I agree to execute, upon request by the Hadassah Foundation, any and all additional documents necessary to effectuate the intent of the above-mentioned rights.

This Event Participant Release shall be interpreted as broadly as possible in favor of the Hadassah Foundation, and shall be governed by and enforceable in accordance with and shall be subject to the laws of the State of New York without regard to its conflict or choice of law provisions. I hereby consent to the exclusive personal jurisdiction and venue of any state or federal court located within the City of New York and waive any objection to jurisdiction and venue of any action instituted hereunder and agree not to assert any defense based on lack of jurisdiction or venue. If any term or provision is declared invalid by a court of competent jurisdiction, the remaining terms and provisions of this Event Participant Release shall remain unimpaired and in full force and effect. If I attend this Event with my child who is under 18 years of age, the terms of this Event Participant Release, including without limitation the terms of any releases and grants included herein, shall apply to both myself and my child in all respects as if my child was originally named herein.
